Terms and conditions listed below governs the use of MotivaLogic Academy’s website (www.motivalogic.com), its platforms, its resources and services. By agreeing to the listed terms, It binds the School and the Students from enrolment to completion of the entire programme.
1.1 “Bootcamp” – a short, intensive, and rigorous course of training with specific duration.
1.2 “School” is MotivaLogic Academy, 77 Lower Camden Street, St Kevins, Dublin 2. Ireland
1.3.“Student” is any individual who uses MotivaLogic Academy’s platform, resources and services at any time and location.
1.4. “Programme” course(s) provided by MotivaLogic Academy.
1.5 “Duration” This is in respect of the duration of the programmes i.e 1 month, 3 months, 6 months
1.6. “Repo” is an allocated cloud environment to student’s working group/team for the storage of code and other educational materials during learning period.
1.7. “Sprint Ceremonies”- are meetings which usually take place 2 weekly at the start of team’s projects, during the evening hours of specified weekdays. MotivaLogic Academy usually hold the following ceremonies;
1.7a “Sprint Planning”- Scheduled for Mondays at 9pm Ireland time to allocate Team projects of 2 week’s duration.
1.7b “Strategy meeting” – Scheduled for Mondays at 9pm Ireland time for knowledge sharing.
1.7c “Sprint Demo” – Scheduled for Fridays at 9pm Ireland time to review Team projects.
1.8.“Tuition” includes the services provided by the Instructors of MotivaLogic Academy.
1.14. Student – MotivaLogic Academy welcomes student from all over the world. It operates a non-discriminatory online learning environment.
2. Admissions criteria & enrolment
Admissions Policy of MotivaLogic Academy accommodates and welcome interest from students from all over the world irrespective of social, racial, religious, and other equality background. With great focus on acceptability towards becoming part of the learning community.
2.2 Admission Criteria
All enrolment and allocation by the Academy would be done with great focus to maintain fairness and equality by ensuring that applicants are assessed individually and are given equal opportunity and support at enrolment at every stage of learning in the academy.
2.2.1 Application for admission should be made directly through the school or through an approved agent. Registration forms for various courses of choice are available on the Academy’s website at https://www.motivalogic.com
2.2.2 Registration criteria: Interested Applicants for Adult courses must be:
- Be over the age of 18.
- Have completed registration form online
- Accept the terms and condition
- Be self-motivated towards learning
- Be willing to take responsibility for their own learning
2.2.3 Availability and commencement of all courses is subject to minimum enrolment. Where the minimum enrolment for a Course is not reached, such course may be cancelled or put on hold with prior notice of one week before the start date, by the School and the School accepts no liability or responsibility for any loss or damage which the student may incur as a result of such cancellation and the student hereby accepts same. Notwithstanding, should the course be cancelled, fees paid will be refunded to the applicant.
2.2.4 Students applying directly are required to make a payment deposit to reserve a place on a course offered by the school, prospective Student should contact the school to make a deposit for an available place on their preferred course.
2.2.5 Payments must be made in accordance with the terms and conditions on the issued invoice.
2.2.5. The balance of the payment must then be made before the student can proceed to work experience. In the event of failure to make payment as outlined on the invoice, the Academy reserve the right to stop the student from proceeding with the Training.
Applicants are obliged to inform the School in writing of any medical issues that may hinder their progress or attendance and of their desire to defer their course. The school reserve the right to review every case individually and make decisions accordingly base on the evidence provided.
3. Class Placement & Induction
3.1 Each student must attend an induction session upon arrival. In the induction session the student will be introduced to key personnel and given information about their course and certification. The student will also be informed of the punctuality policy, attendance policy and other rules of the school. Students will be introduced to the Program manager, receive their study timetable and other relevant information about the program.
3.2 The placement of a student in a particular module of the program will be made by the school on the basis of a short interview. The school’s decision as to assigning the students to an appropriate level of study is final and the Student hereby accepts and acknowledges that:
3.2.1 While the School will use its reasonable endeavours to accommodate the Student in relation to study level, any change to the Student’s study level will be based on formative and summative assessment and at the School’s absolute discretion
3.2.2 The School accepts no responsibility or liability for any loss or damage which the Student may incur as a result of the decision of the School regarding his/her level of study. The Student hereby accepts and acknowledges same.
4. Assessments and Interview
4.1 The school will provide ongoing formative and summative assessments and review/feedbacks throughout the training period courses. All instructors and Leads will provide non-discriminatory support during classes.
4.2 Interview Preps will be provided based on the summative assessment and feedbacks from the Leads/Instructors to students who have successfully completed both coursework and work Experience.
5. Course Completion
5.1 Student who have successfully completed both coursework and work Experience only would be given certificate of completion and work Reference at recommended duration of 6 months. The required minimum attendance rate of 85% applies to both the coursework and Work experience. The School will only issue a completion certificate if attendance and performance has been satisfactory in the School’s opinion.
Please note that references are given only to students who have successfully completed all assigned lab assignments and the capstone project in coursework and fully participated and completed each of the projects during the Work experience. Students will be required to complete on their own end to end one of the projects and have demonstrated full understanding of the Agile process of work.
6. Attendance, punctuality, and absenteeism
6.1 The School will make all reasonable endeavours to set and maintain a reasonable timetable. However, timetables are set at the sole discretion of the School and may be subject to change and the Student accepts same.
6.2 There is no obligation on the School to reschedule classes or to organise any additional classes to make up for any classes the Student has missed and the Student accepts same.
6.3 Full attendance of the coursework and daily stand-ups are highly recommended to all students.
6.4 Students failing to meet the attendance requirement are notified immediately of the situation first by email and/or over the phone.
6.5 When attending meeting, it is highly recommended for all attendees to join all meeting using their real names and not Aliases. This is to ensure utmost privacy and to prevent data breach. Students who fail to comply will be exited from the respective meetings.
7. Equality and Code of Behaviour Policy
7.1 All courses are designed to be progressive and developmental by nature. Therefore, having enrolled, students are expected to engage fully in pursuit of the intended learning outcomes
7.2 Students are encouraged to actively participate in any other activities run by the school.
7.3 The school is committed to providing a positive community environment in an atmosphere of respect, collaboration, openness and equality on the following grounds:
- Gender: this means man, woman or transsexual
- Civil status: includes single, married, separated, divorced, widowed people, civil partners and former civil partners
- Family status: this refers to the parent of a person under 18 years or the resident primary carer or parent of a person with a disability
- Sexual orientation: includes homosexual, bisexual and heterosexual
- Religion: means religious belief, background, outlook or none
- Disability: includes people with physical, intellectual, learning, cognitive or emotional disabilities and a range of medical conditions
- Race: includes race, skin colour, nationality or ethnic origin
- Membership of the Traveller community.
7.4 Instances of bullying, discrimination harassment and victimisation are unacceptable.
7.5 The school operates zero tolerance to aggression. This includes both physical and verbal acts of aggression.
8. Health and Safety Policy
8.1 The school’s policy is to provide and maintain a safe and healthy student community, that will provide ongoing support to all students and that will embrace the beauty of diversity, respect for self and others hence, promoting good mental health.
8.1.1 Students also accept responsibility for the health and safety of other people who may be affected by their actions. In that regard:
8.1.2 Students are expected to take reasonable care to ensure the health and safety of themselves and others.
8.2 Students are liable for any damage caused by them and payment for such damage must be made immediately.
10. Fees, Cancellations & Refund Policy
10.1 The school reserves the right to cancel course on the grounds of insufficient number of bookings. In such a case all candidates who have paid the fee will receive a full refund.
10.2 Cancellations by students of a course made no later than by the end of the first week of classes will result in a refund of paid fees less an administration fee of 100EUR. No later cancellations can be subject to a refund.
10.3 The School is under no obligation to refund any tuition fees based on Student’s unreported absence, irrespective of reasons for the absence.
10.6 Cancellation by a Student must be in writing by way of an email to firstname.lastname@example.org
10.7 No refund of tuition fees will be given if a student has commenced their course and is dissatisfied with the allocated level of study
10.8 The course fees include tuition, a set of course materials and a certificate of course completion.
10.9 Course fees are listed on the school’s website and are subject to change without any notice. With the exception of academic year programmes, once a booking has been made and deposit paid for a particular course, the student is required to pay the balance of the fees displayed at the time of booking, irrespective of the current fee displayed on the website.
10.10 In the event of a teacher not arriving in class due to illness, accident or other unforeseen circumstances the School will do its utmost to find a replacement teacher and in the event that this is not possible the particular class or lesson will be rescheduled to a different time or day and all involved students will be notified in advance.
10.11 All the refunds will be processed within 10 working days from the date the refund has been requested provided the student has submitted the following information required to process a bank transfer:
- Name of the account holder
- Address of the account holder
- Bank name and branch address
11. Intellectual Property
11.1 All Intellectual Property Rights in, or arising out of or in connection with, the Service shall be owned by us.
11.2 We will defend the intellectual property rights in connection with our Products or Services and Our Website, including copyright in the Content whether provided by us or by any other content provider (including copyright in: text, graphics, logos, icons, images, audio clips, videos, digital downloads, data, and software).
11.3 All Course Materials are protected by copyright and are intended only for your individual learning purposes.
11.4 The Course Materials provided to you may contain licence agreements from parties aside from Us. Your Enrolment is subject to your compliance with any applicable licence agreements.
11.5 Except as set out below, you may not copy, modify, publish, broadcast, transmit, transfer or sell, reproduce, create derivative works from, distribute, perform, display, or in any way exploit any of the Content or any of the Course Materials, in whole or in part. However, you may:
- retrieve and display the Course Materials and content from the Learning Portal on your computer screen; and
- print one copy of the Course Materials – but not copy or share them in any manner; and
- store the Course Materials in electronic form – but not on any server or other storage device which is connected to a network
- You will be responsible for making good any loss We suffer if you use or copy the Course Materials, other than in accordance with these Terms and Conditions.
11.6 You may not use our name or logos or trademarks or any other Content on any website of yours or that of any other person, without our express written permission.
11.7 Subject to the other terms of this agreement, you may download permissible Content only for your own personal use, provided that you maintain all copyright and other notices contained in it. You may not store electronically any significant portion of any Content.
12. Photos, Screenshots & Videos recording
Class video recordings and screenshot taken by the school during the classes and social activities organised by the school maybe be on the school’s website, printed promotional materials and social networks for the purpose of the school’s promotion and teachers’ training unless the student specifically objects and withdraws their consent to same in writing. Students will not be paid for the time involved in the taking of such photographs or video footage and will assign to the School any rights to royalties they may have arising from taking of these photographs or video footage. The copyright to all photographs and video footage belongs to the School.
13. Transferring and Exchange Courses
13.1 If you purchase the Course as a Student, your Enrolment in a Course is personal to you and you may not transfer the Course to any other person.
If you have purchased a Course on behalf of your company or organisation, and have provided that company’s/organisation’s details to us, we may, at Our discretion, transfer your Enrolment/s to other people within your company/organisation only.
13.2 Please contact us on email@example.com if you wish us to consider such a transfer.
13.3 We may at any time assign, transfer or deal in any other manner with all or any rights under this agreement and may subcontract or delegate in any manner any or all of Our obligations to any third party or agent.
13.4 We, at Our sole and absolute discretion, may allow you to apply your Course Fees as a credit against any other Course offered by Us, provided that all of the following conditions are satisfied:
- you notify us within seven (7) business days from your Enrolment Date of your desire to transfer to an alternative Course;
- the Course Fee for the alternative Course is equal to, or less than, the original Course Fee, or you agree to pay Us the difference where the Course Fee for the alternative Course is higher than the original Course Fee;
- you consent to us disabling your login details to preclude continued access to any online training Course Materials in respect of the original Course;
you agree and warrant that you have not made any copies of the Course Materials or reproduced them in any way; and
- you agree and warrant that you have destroyed any Course Materials which you downloaded onto your computer system, or any other such device, as well as destroyed any hard copies of Course Materials that you have gained through the original Course.
14. Your Account With Us
14.1 You agree that you have provided, and will continue to provide, accurate, up to date, and complete information about yourself. We need this information to provide you with the requested Products or Services.
14.2 If you use Our Website, or any associated Learning Portals, you are responsible for maintaining the confidentiality of your account and password and for preventing any unauthorised person from using your account.
You agree to accept responsibility for all activities that occur under your account or password. You should tell us immediately if you believe someone has accessed your account without your authority and also login to your account and change your password.
You agree to indemnify us against all costs, claims and expense arising directly or indirectly from:
- your failure to comply with the law of any country;
- any act, neglect or default by any agent, employee, licensee or customer of yours;
- a contractual claim arising from your use of the Products or Services;
- a breach of the intellectual property rights of any person.
16. Job Guarantee or Money Back Policy
We will endeavour for a period of 6 months from successful completion of your Program to obtain for you a Job opportunity within your chosen field.
If no job opportunity has been offered upon successful completion of the mandatory Coursework, Work experience & Career modules and 6 months has passed then we will refund all monies other than Bank, Payment gateway or financial services partners charges within 10 working days provided that all the following conditions have been fulfilled:
- Successful completion of the course work with a minimum of 85% attendance.
- All 10 labs during the coursework has been successfully completed
- Successful completion of all 20 real world projects
- Successful completion of the work experience with a minimum 85% attendance
- Successful completion of all 4 projects during the work experience.
- Successful completion of Ansible Auto discovery and Pet Shop microservices Kubernetes project end to end, documented and presented to the leadership team
- Completed career stage module successfully
- Successfully obtained AWS Certification at the Minimum cloud Practitioner level
- All monies owed by you must be paid in full.
- No offer of a job with a starting salary of €40,000 or more per year has been made to you.
- Have not failed to attend a job interview without a valid reason
- Have not failed to respond to our or our partner’s communications during the recruitment process.
- Do not require sponsorship and have the right to work in the UK, Ireland, US and Canada indefinitely.
You are not obligated to but if you choose to accept a job offer for less than our salary guarantee outlined above this will void the money-back guarantee. This could be applicable for students seeking part-time or contract positions instead of full time.
The Job guarantee or money back scheme is only valid for students in UK, Ireland, USA and Canada.
17. Grievance Procedure
17.1 Students have a right to complain. A system is in place in the School to deal with complaints. The complaints process is defined by the three stages outlined below.
17.2 Stage one:
Firstly, the issue will be informally addressed with the relevant individual(s) and an attempt to resolve the situation will be made. Should this prove unsuccessful, complainants may progress to the second stage.
17.3 Stage two:
The student should request and complete a complaint form, ensuring to provide full details of the nature of the complaint. They should return the enclosed form along with any relevant documents, addressed to the Manager. Once the complaint has been received, it will be reviewed by the Manager and responded to within seven working days. Where appropriate the Manager will provide a full explanation of any relevant errors and details of any remedial action taken.
17.4 Stage three:
After stage two has been completed, the school will consider the matter resolved. If the complainant remains dissatisfied, the school will advise the complainant to bring the matter to the attention of the relevant statutory authority. Contact details for relevant authority will be provided.
17.5 All complaints will be dealt with confidentiality.
17.6 The complainant will be treated impartially and the fact they have made a complaint will not affect the quality of the service they receive from Motivalogic Academy.
18. Disciplinary Action and Expulsion policy
18.1 The School endeavours to resolve any conflict or issue that arises in a timely manner by means of positive informal communication with all parties involved. However, in cases when this does not bring a resolution or if there is a serious breach of the school policies, the disciplinary procedure may be initiated.
18.2 If a student breach any of the school policies, the following disciplinary procedure may be operated:
18.2.1 Stage one
A verbal warning will be issued to the student by the Manager.
18.2.2 Stage two
If the student continues to breach a particular policy or rule, a first written warning will be issued to the student by the Manager.
18.2.3 Stage three
If the student continues to breach a particular policy or rule, a final warning is issued. The student is also informed that if his/her behaviour does not change within agreed period of time, they may be expelled.
18.2.4 Stage four
If the student continues to breach a particular policy or rule and the behaviour has not improved within the agreed period of time , the Manager may issue an expulsion letter and the Student may be removed from the school register.
18.3 In extreme circumstances, where a student’s behaviour poses a threat to themselves, other students or members of staff, they may be suspended or expelled with the immediate effect and relevant authorities will be notified
18.4 Once the student receives the letter of expulsion they have a right to appeal the decision in writing to the Manager within 5 working days from the date they received the letter. The appeal will be processed by a panel consisting of the Manager, the Course co-ordinator, one teacher appointed by the Manager and one teacher chosen by the student. It will be processed within the following 5 working days and the student will receive a final decision in writing.
19. Governing Law
The above school terms, conditions and policies shall be governed by Irish Law and do not affect a Student’s statutory rights under Irish Law.
